1. Definitions

In these Terms and Conditions, the following definitions apply:

"Akar", "we", "us", "our" — Akar, a financial education provider operating at Level 16, Menara Prudential, Persiaran TRX Barat, 55188 Kuala Lumpur, Malaysia.
"Programme" — any workshop, course, or structured education session offered by Akar, including the Building Money Confidence Workshop, the Steady Habits for Life Programme, and the Long-Term Money Confidence Course.
"Participant" / "you" / "your" — any individual who accesses our website, submits an enquiry, or registers for a Programme.
"Content" — all materials, workbooks, session guides, notes, videos, or resources provided as part of a Programme.
"Agreement" — these Terms and Conditions, our Privacy Policy, and any confirmation correspondence relating to your enrolment.
"Website" — the Akar website accessible at akari.sbs.

2. Acceptance of Terms

By accessing the Website, submitting an enquiry, or enrolling in a Programme, you confirm that:

You have read, understood, and agree to be bound by these Terms and Conditions.
You are at least 18 years of age, or have the legal capacity to enter into a binding agreement under Malaysian law.
You are entering this Agreement voluntarily and with full understanding of its nature.

If you do not agree to any part of these Terms, please do not use the Website or enrol in a Programme.

3. Service Description

Akar provides general financial education and information services to the public in Malaysia. Our Programmes are designed to help individuals build awareness, understanding, and confidence in managing their personal finances. All content is educational in nature.

Our current Programmes include:

Building Money Confidence Workshop — a half-day (4-hour) group session with worksheets and habit guides. Fee: RM 510.
Steady Habits for Life Programme — six sessions over six weeks with a habits journal, routine planner, and support circles. Fee: RM 1,700.
Long-Term Money Confidence Course — twelve sessions over three months with workbooks, review clinics, and ongoing material access. Fee: RM 4,300.

Programme availability is subject to scheduling and capacity. Akar reserves the right to modify programme formats, dates, or facilitators with reasonable notice to enrolled participants.

Our services are offered primarily in Malaysia. Participants based outside Malaysia may enquire, but delivery logistics will be assessed on a case-by-case basis.

4. Enrolment & Participation

Enrolment in a Programme is confirmed upon receipt of full payment and a written confirmation from Akar. Places are allocated on a first-come, first-served basis. Submitting an enquiry form does not constitute confirmed enrolment.

Participants are expected to:

Attend scheduled sessions punctually and engage respectfully with facilitators and fellow participants.
Notify Akar promptly if they are unable to attend a session, where possible with at least 48 hours' notice.
Maintain the confidentiality of information shared by other participants in group settings.

Akar does not issue formal certifications, diplomas, or accreditations. Participants receive a completion acknowledgement for courses where all sessions are attended.

5. User Responsibilities

When using the Website or participating in a Programme, you agree not to:

Provide false, misleading, or incomplete information in any enquiry or registration form.
Reproduce, distribute, or commercially exploit any Programme Content without Akar's prior written consent.
Record sessions (audio or video) without the express consent of Akar and all participants present.
Engage in conduct that is disruptive, disrespectful, or harmful to other participants or facilitators.
Use the Website for any unlawful purpose or in a manner that could damage Akar's reputation.
Attempt to gain unauthorised access to any system or data related to Akar's operations.

Akar reserves the right to remove any participant from a Programme without refund where conduct is deemed seriously disruptive or in breach of these responsibilities.

6. Intellectual Property

All Content, materials, methodologies, session frameworks, and Website content produced by Akar are the intellectual property of Akar and are protected under Malaysian copyright and intellectual property law.

Upon enrolment, Akar grants you a limited, non-exclusive, non-transferable licence to use Programme materials for your personal, non-commercial educational purposes only. This licence does not permit:

Sharing, reproducing, or distributing materials to third parties.
Using materials to deliver training, workshops, or educational sessions to others.
Publishing or publicly displaying any portion of Programme Content.

All rights not expressly granted are reserved by Akar.

7. Payment & Fees

All fees are quoted in Malaysian Ringgit (RM) and are inclusive of applicable taxes unless stated otherwise. Full payment is required to confirm enrolment. Payment details will be provided upon enquiry.

Akar accepts payment via bank transfer and other methods notified at the time of enrolment. Akar does not store payment card details.

Fees for each Programme are as listed in Section 3 above and on the Website at the time of enquiry. Akar reserves the right to revise programme fees with reasonable advance notice; any revision will not apply to confirmed enrolments already paid.

8. Refund Policy

Refund requests are considered as follows:

Cancellation by participant — more than 14 days before the programme start date: Full refund, less a RM 50 administrative processing fee.
Cancellation by participant — 7 to 14 days before the programme start date: 50% refund of the programme fee paid.
Cancellation by participant — fewer than 7 days before the programme start date: No refund. Where possible, transfer to a future cohort will be considered at Akar's discretion.
Cancellation or postponement by Akar: Full refund of the programme fee paid, or the option to transfer to a rescheduled session.

Refund requests must be submitted in writing to [email protected]. Refunds will be processed within 14 business days of approval.

9. Disclaimers

Akar's Programmes and Website provide general financial education and information only. Nothing in our content constitutes, or should be construed as, regulated financial advice, investment advice, legal advice, tax advice, or any other form of professional advisory service.

Participants are encouraged to consult qualified and licensed professionals before making any financial decisions. Akar does not recommend specific financial products, investment strategies, or service providers.

The Website and Programme Content are provided on an "as available" basis. While we take care to keep information current and accurate, Akar makes no warranties — express or implied — as to the completeness, accuracy, or fitness for purpose of any content.

10. Limitation of Liability

To the fullest extent permitted by Malaysian law, Akar shall not be liable for any indirect, incidental, special, or consequential loss or damage arising from your participation in a Programme or use of the Website, including but not limited to:

Financial decisions made on the basis of Programme Content.
Loss of income, savings, or opportunity.
Interruptions to programme delivery due to circumstances beyond Akar's reasonable control.

Akar's total aggregate liability to any participant shall not exceed the programme fee paid by that participant for the relevant Programme.

Nothing in these Terms limits liability for death or personal injury caused by Akar's negligence, or for fraud or fraudulent misrepresentation.

11. Indemnification

You agree to indemnify and hold harmless Akar, its facilitators, and staff from and against any claims, losses, costs, or damages (including reasonable legal fees) arising from your breach of these Terms, your misuse of Programme Content, or your conduct during a Programme session.

12. Termination

Either party may withdraw from a Programme arrangement in accordance with the Refund Policy in Section 8. Akar may suspend or terminate a participant's access to a Programme without refund in cases of serious or repeated breach of these Terms, or where continued participation would be detrimental to other participants.

Sections relating to Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Dispute Resolution shall survive any termination.

13. Dispute Resolution

These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from or in connection with these Terms shall first be addressed through good-faith informal discussion between the parties.

If resolution cannot be reached informally within 30 days, the parties agree to submit the matter to mediation under the rules of the Malaysian Mediation Centre before pursuing any legal proceedings.

The courts of Malaysia shall have exclusive jurisdiction over any disputes that proceed to litigation.

14. General Provisions

Entire Agreement: These Terms, together with our Privacy Policy and any enrolment confirmation, constitute the entire agreement between you and Akar regarding Programme participation.
Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
Waiver: Akar's failure to enforce any right or provision at any time does not constitute a waiver of that right or provision.
Assignment: You may not transfer or assign your enrolment or rights under these Terms to any third party without Akar's written consent. Akar may assign its rights and obligations without restriction.
Notices: Formal notices under these Terms should be directed to Akar at the address or email below.

15. Changes to Terms

Akar may revise these Terms from time to time. When material changes are made, the "Last Updated" date will be amended, and enrolled participants will be notified by email. Your continued participation in any Programme after the effective date of revised Terms constitutes acceptance of those changes.

We recommend reviewing these Terms periodically for any updates.
